Terms of Service

 

Buying digital products from Sαтαη 𝓓𝓪𝓻𝓵𝓲𝓷𝓰 and what rights you have to the artwork you receive. 

 

What does a T.O.S tell me?"

 

This document is where the artist lays out their rights and the patrons rights to the product being delivered. A T.O.S is a set of official rules in which one must agree to abide by in order to use a service."By buying custom artwork (A.K.A commissions) from SatanDarling you are agreeing to this T.O.S automatically. Please read this entirely and carefully. I will deny your request and commission if it is made clear to me that you did not read this T.O.S. If you have ANY questions or concerns, do not hesitate to contact me directly.

 

What are my rights? What is happening with the artwork I order and receive? What kind of orders can I get?

 

> I reserve all rights to decline a commission and reject service with or without reason. Harassment following rejection will be reported and is unnecessary. 

> You have no right to alter the original artwork in any way, shape, or form. This includes tracing, using as a template, recolouring, removing watermarks or signature, or anything that would otherwise count as misuse of my artwork. 

> Using or placing the artwork you receive as a buy-able print, canvas print, t-shirt print, sticker, etc, will result in immediate violation of this T.O.S. You do not own this artwork, you may not make a profit off of it, or otherwise reproduce it in any way, shape, or form. This is a violation of the artwork you receive.  

> You have, with written permission and proper credit, the right to re-upload the artwork to your personal account.

> You must credit, or link back to me or the original art piece, failure to do so will result in violation of this T.O.S and you will never again be able to order from me. 

> Commission pieces you order from me must include a subject, or character that has an owner of its own. Commissioning me for "A random white wolf" or "Your favourite car" is not a type of commission I accept. You need to provide to me a reference sheet, or the original adoption sheet (given that colours and features are clearly shown and recognisable.) Failing to provide me a proper reference sheet, giving me paragraph descriptions of a character, or giving me google links will result in a decline of service.  

> If you no longer own the character that is depicted in the original artwork, you may not keep the artwork uploaded to your account, and must delete it immediately (please send new owner to this T.O.S). 

=There are some things I will not draw, simply out of respect for others or due to Deviantart rules. Do not order these types of commissions, as it will allow me to decline service to you:

 

 

  • Racism or Sexism

  • Hate messages, or violence against another group of persons/person.

  • Extreme Fetishes (scat, vore, inflation, bestiality, etc..)

  • Rape or forced sex/sexual themes.

  • No copyrighted characters (Video game/TV show/or branded characters)  Normal Commissions are commissions that include G-PG13 rated material that is otherwise geared towards a more general audience. Normal commissions will be posted to Deviantart. There are things that I am more comfortable drawing, these are subjects I have more confidence in drawing, but also tend to my personal preferences: (Please understand that with each species my style will show through. If you're looking for less stylised work, please go elsewhere. Look at my gallery to get a feel for what style I have.)

 

 

> Anthro commissions are commissions that include an anthropomorphic creature that

  • a) Has distinctive human like features or anatomy, or

  • b) Human acting in clothing/anatomy animal.

> Anthro commissions automatically take longer, and are put on lowest priority (I like to take my time and make sure the anatomy is right.)

> Anthro commissions may cost more, due to clothing, or extravagant poses that are out of the normal.

 

> NSFW (Not Safe For Work) commissions are commissions that may include material that is otherwise geared towards a mature audience. NSFW material is classified as sexual themes, pornographic, or suggestive and sensitive material. I will not take commissions of this type due to the fact that I am uncomfortable with my ability to draw these types of artwork.

 

Payment methods and options? What am I in for when I pay you for work? 

 

I accept two forms of payment and two forms of payment only. Cash payments are accepted via Paypal, and deviantART points are accepted via the donation widget.

> Payments of cash are to be sent via paypal invoice once your commission is confirmed by me.

> Payments with points are to be sent to me via donation widget once I have confirmed your commission. 

>  All commissions will be paid upfront in full. Failure to do so will result in rejection of commission.  

> Payment must be in hand or must be incoming, failure to have the money coming to you (before ordering) will result in rejection of commission. I will wait up to 3 days for incoming payments. During this time your spot will be reserved but I will not start any work you ask of me. 

 

> PayPal Method:

Once your commission has been accepted and the price has been confirmed between the two of us, I will ask for your paypal and send you an invoice.

> Failure to pay the correct payment that was otherwise agreed on beforehand will result in a warning from me. If you continue to not pay the fees correctly, I will refund you and reject service.

> I am not holding myself responsible for refunded conversion rates (i.e you converted your payment to USD, but when refunded you get less back due to conversion rates.)

> I will refund you only what I received, in the currency I received. 

> PayPal payments must be in USD. 

 

> deviantART Points Method: 

When buying points from DA yourself - 1 USD = 80 

This is what I receive - 100  = 1 USD. 

 

> Once your commission has been accepted and the price has been confirmed between the two of us, you must send the points immediately within three days.

 

What if I want a refund?

 

> I will not be lenient with refunds, as you are agreeing to a service and need to, like myself, follow through on that service unless issues arise that are out of my control and prevent me from completing your work.

> Randomly requesting a refund with no clear reason or too soon will result in a rejection of refund.

> If you send through paypal and refund your unclaimed payment before it is claimed, or filling a charge-back without my written consent and knowledge, is a violation of this terms of service.

> If you continue to have further use of the artwork you received it will be considered theft, and is a violation of my original property. If this cannot be fixed, I reserve the right to sell/alter/delete the original artwork. 

> You need a reason to refund from me, here are the reasons I will agree to, anything else brought to me will be considered unreasonable;

 

Coming to me for the following reasons will be accepted:

 Refunds will be paid back in full unless I have already started your piece, then only half will be refunded to you, as I have spent my time on the piece and deserve the money for the time I've spent.

  • Your commission has taken more than 6 months with no notification from me that it is started, in completion, or done (excluding a few touch ups.) I will let you consider this me ignoring you, and you can reserve the right to refund from me in this case. IF I have notified you of any arising issues/downtime and you have previously agreed to continue on with the commission and I have proof, you will not receive a refund at all.

  • If your commission cannot be completed by me, I will fully refund you if you agree to do so. Saying "No, it's OK, you can keep it." means I will absolutely not refund you later down the line. Coming to me 1+ month(s) after the fact, asking for a refund, will not make me give you a refund. I will take your initial word for it, nothing else after the fact.

 

Coming to me for the following reasons will not be accepted:

  • You didn't particularly like how the piece came out: I'm more than willing to redo if I feel that the commission is also not up to par, and you will know this when I offer a redo. Otherwise you being unhappy with a certain part of the piece is subjective, and I cannot please or account for everyone's happiness.

  • If you're not happy about the stylised work: I trust that you have looked into my gallery before ordering, and you know what you may or may not get. End of story.

  • If you did not like how your character came out: If there is anything on the character you want emphasised you NEED to notify me about that within the ordering process. If I draw something wrong or not to your liking on your character, or don't 'draw their correct personality' that is not my fault. These are things you need to specify.

  • You feel like your commission will never get done: This is not your decision. I decide whether or not if I can do a commission, regardless of how long it takes. If I feel I am able to complete the commission, have it in process or sketched, I will not refund you. Be patient. If I have constantly notified you telling you (or making a public journal update) that commissions may take a while, you need to be patient. This means I have started or am in the process of finishing these commissions. Unless it has reached 6 months, do not contact me about the process of your commission, I will contact you if any issues have arise and I cannot finish your work.

About wait times:

  • Wait times can range from 1-4 months, depending on how busy I am. I will always do my best to give updates on a weekly or bi-weekly basis to ensure that I am doing your commission.

  • Certain orders may get priority if I feel they are easier and it would be best they are completed before others.
